"abstract": "Legal pluralism in inheritance law in Indonesia often generates\r\nnormative tensions between the textual certainty of Islamic\r\njurisprudence (farā’iḍ) and customary legal practices that are\r\nembedded in society as living law. Doctrinally, Qur’anic Surah al-\r\nNisā’ verse 11 establishes a 2:1 ratio in the distribution of\r\ninheritance between male and female children as a qaṭ‘ī provision.\r\nHowever, the Muslim customary community of Kampung Naga in\r\nTasikmalaya consistently practices an equal 1:1 inheritance\r\ndistribution through guar waris deliberations based on the\r\nphilosophy of repeh rapih. This gap between normative texts and\r\nempirical reality raises fundamental academic questions concerning\r\nhow the dialectical negotiation between customary norms and\r\nIslamic law takes place, how religious and customary leaders\r\nemploy legal reasoning to resolve such differences, and what\r\nrationales underlie the preference of the Muslim community of\r\nKampung Naga for an equal distribution scheme rather than the\r\nmathematical formula prescribed by farā’iḍ.\r\nThis study is a qualitative field study employing a descriptiveanalytical\r\nmethod and a socio-legal approach complemented by a\r\nsociological perspective. Data were collected through triangulation\r\ntechniques, including in-depth interviews with key informants\r\nconsisting of the Kuncen, Punduh, Lebe, village officials, and six\r\nheir families; participant observation of guar waris deliberations;\r\nand documentary analysis of village land administration records.\r\nThe theoretical framework integrates William Ury and Roger\r\nFisher’s Principled Negotiation Theory, Talcott Parsons’ Structural\r\nFunctional Theory through the AGIL scheme, the Thomas-Kilmann\r\nConflict Mode Instrument (TKI), Najmuddīn al-Ṭūfī’s theory of\r\nmaṣlaḥah, and Islamic gender hermeneutics developed by Amina\r\nWadud and Asma Barlas. Data were analyzed through an\r\ninteractive qualitative process involving data reduction, data\r\ndisplay, and verification\/conclusion drawing, supported by\r\ninductive-deductive reasoning.\r\nThe findings reveal three main results. First, the negotiation\r\nbetween customary law and Islamic law is manifested in an\r\nIntegrative-Accommodative Negotiation Model based on rapih while mitigating potential conflicts among siblings,\r\nexpressed through the concepts of bencekeweng and matak tumpur.\r\nThe philosophical rationality of al-Ṭūfī’s maṣlaḥah is reflected in\r\nthe effort to prevent harm (dar’u al-mafāsid), preserve family\r\nwelfare, and realize the objectives of maqāṣid al-syarī‘ah.\r\nMeanwhile, substantive gender-justice rationality is associated with\r\ntransformations in family economic structures and the distribution\r\nof family responsibilities, whereby the contributions of daughters\r\ncannot always be assessed solely through traditional gender-role\r\nconstructions. In this context, greater recognition is accorded to the\r\ncare work performed by daughters in accompanying and caring for\r\naging parents. Such recognition is given concrete expression\r\nthrough the management and utilization of sagunuk assets as part of\r\nthe family’s socio-economic mechanism. Therefore, the choice of a\r\n1:1 distribution can be understood as a reconstruction of justice that\r\nconsiders not only mathematical equality of shares but also\r\ncontribution, responsibility, familial relationships, welfare, and the\r\nsustainability of social life within the Kampung Naga community.\r\nThe study makes a theoretical contribution by reconstructing a\r\nTriadic Convergence Model involving Islamic Law, Customary\r\nLaw, and Positive Law within the study of legal pluralism in\r\nIslamic family law. It demonstrates that customary law and Islamic\r\nlaw can engage in a symbiotic dialogue, producing a form of living\r\nlaw oriented toward justice without necessarily negating one\r\nanother. Practically, the study provides an epistemological\r\ncontribution for Religious Court judges and legal mediators by\r\nencouraging the use of relational-communal negotiation approaches\r\nand the doctrine of taṣāluḥ, as accommodated under Article 183 of\r\nthe Compilation of Islamic Law, in resolving inheritance disputes.\r\nIt also provides a policy reference for regional and village\r\ngovernments in harmonizing customary land administration in a\r\nmanner that ensures legal certainty (rechtzekerheid) while\r\nprotecting the rights of indigenous communities.",
