"One of the issues in Islamic marriage law, discussed among\r\nscholars since the classical period, is that of kafa'ah. Views differ,\r\nwith some scholars arguing that kafa'ah is one of requirements\r\nfor a marriage's validity, with invalidity resulting from its nonfulfillment.\r\nOthers see kafa'ah only as a recommendation for the\r\nsustainability of family life and harmony between husband and\r\nwife. On this view, the validity of a marriage is not determined\r\nby kafa'ah. A related issue is that of qualifications, about which\r\nscholars also disagree. The Hanafi school, for instance, stated\r\nsix qualifications of kafa'ah, Syafi'i five qualifications, while Maliki\r\nonly three. This paper investigates these issues of status and\r\nqualifications, both from classical and contemporary points of\r\nview, after discussing the meaning, basis and origins of the\r\nconcept of kafa'ah in Islamic marriage law. It will be shown that\r\ndiffering points of view as to the status of kafa'ah result from\r\ndiffering understandings of the basis of kafa'ah. Similarly, the\r\ndiffering views as to the qualifications can be explained by the\r\ndifferent contexts (spatial and temporal) of the relevant scholars."^^ . "2003-06-01" . . .
