"Nasr Hamid Abu Zayd has, as a critical scholar,\r\nkis own perspective in understanding \"texts\",\r\nincluding the \"texts\" by al-Syafi'i on al-Sunnah.\r\nIn his standpoint, al-Sunnah is a phenomenon\r\ncalling for an in-depth inquiry in a mutti-disciplinary\r\nmanner, so that it wiU not be limited to\r\nmerely traditional discussion. Thus, by semiotic\r\nand kermeneutic approaches, Abu Zayd tries to\r\nview al-Sunnah through al-Syafi'i's perspective.\r\nHe argues that, on the one hand, al-Syafi'i considered\r\nal-Sunnah as an independent source of\r\nlaw, even a revelation. On the other hand, al-\r\nSyafi'i maintained that al-Sunnah cannot abrogate\r\nal-Kitab. According to Abu Zayd, it is at\r\nthis point he reflects kis inconsistency. Abu Zayd\r\nsays that some people have been arguing that al-\r\nSyafi'i is a mediator between the rationalists\r\n(ahl al-ra'yi) and the traditionalists fahl alhadithj.\r\nHowever, the fact shows that he tended to\r\nstick himself to ahl al-hadith and considered qiyas\r\nas, despite its basis on the general principles of\r\nsyari'ah, a far powerless source of law compared\r\nto hadits ahad, even the mursal, or whose validation\r\nis debatable.\r\nAl-Syafi'i and the Hanafists are in agreement\r\nwith hujjah-n^ss of hadits mutawatir and hadits\r\nmashhur. Contrary to his view on hadits ahad, al-\r\nSyafi'i argued that the latter could, regardless of\r\nits mursal, provide that it was in line with a\r\nmajority ofulama's fatwa, be applied as hujjah,\r\nas in cage of hadits mutawatir and hadits mashhur\r\nstated above. The Hanafista, otherwise, put the\r\nmain point on qiyas which was rational in nature\r\nrather than on hadits ahad. For them, the\r\naxiomatic content was not only restricted to al-\r\nKitab and al-Sunnah, particularly when the latter\r\nis mursal, but qiyas was necessary to be taken\r\ninto account as well when the religion-based definitive\r\nlaws support it"^^ .
