Abstract

Exploitation is a part of trafficking crime which should be eradicated, and unfortunately we find the exploitation action at some point in Yogyakarta. At 2011 the government of Yogyakarta has made a local regulation for eradication of the exploitation, which one this exploitation action make the child as a victim. Although the government has made a Local Regulation of Yogyakarta No. 6 of 2011 about Street Children which aims to show a kind of responsibility for children who has exploited in the street, but in fact there is many of child to be a victim against the exploitation action. Besides in Local Regulation of Yogyakarta No. 6 of 2011 about Street Children or in other legislation about the child already mentioned about many consequences and sanction for parents or everyone who has exploited the child in the street. For that, required a discussion and application for what has been applied in legislation and what should given to parents or everyone who exploited the child in street. On this basis, the author very interested on the exploitation of child. It is important for the author doing the research and discuss about the issue entitled: “The Application of Criminal Punishment for Parents Who Exploit The Child in Street at Yogyakarta.” This research aims to know a criminal punishment for parents or everyone who exploit the child in the street according to Act No. 23 of 2002 about Child Protection and Local Regulation of Yogyakarta No. 6 of 2011 about Street Children, and for determine about the criminal punishment has been applicated as written in the legislation. This research is juridical empirical research, which in this using a descriptive analysis and in this undergraduate thesis a form of quantitative research. The result of this research show the legislation about exploitation prohibition has enough detail about the criminal punishment, it is just the application in the field not accordance with as written in legislation and not enough for eradicated the parents or everyone who exploit the child in street. Based on the results of research by the author of that other forms of exploitation of children in the street at Yogyakarta are as begging, busking, and dancing. And factors of children exploitation practice after the author doing the research are poverty, socio-cultural, and law enforcement. Actually in Yogyakarta there is not an eradication from the government to give a criminal punishment detterent effect that raises for parents who exploit the child in street at Yogyakarta according to article 46 Local Regulation of Yogyakarta No. 6 of 2011.
