Abstract

The rapid growth and development of the Islamic bank is important to be coupled with the application of Good Corporate Governance (GCG). This implementation is aimed in order to build public confidence by ensuring compliance with sharia compliance. GCG applied in sharia banks is actually a combination of GCG theory coupled with theories on sharia compliance in which the monitoring is carried out by the Sharia Supervisory Board (DPS). However, in the application of sharia compliance, Islamic banks have not been fully sharia-compliant, such as in the contract of murabahah, mudarabah and musyarakah. The total number of BPRS (Sharia Community Bank) reached 154 banks until 2011. Of these, 31 BPRS were in Central Java and Yogyakarta. Based on the background of the problem, this study focused the discussion on how the application of sharia compliance, the practice of good corporate governance principles and DPS role in overseeing the implementation of sharia compliance on BPRS located in Central Java and Yogyakarta. The reason behind the selection of this location was because these two regions were known to have relatively many numbers of BPRS in Indonesia. There were three objectives in this study, i.e., analyzing the implementation of sharia compliance on the BPRS in Central Java and Yogyakarta, analyzing the practice of corporate governance principles in the BPRS in Central Java and Yogyakarta, and analyzing the role of DPS in the application of sharia compliance on the BPRS in Central Java and Yogyakarta. To answer the three research objectives, the data collection methods used were observation, interviews, questionnaires and documentation. This study employed descriptive and qualitative analyses, which described and analyzed the implementation of sharia compliance, the practice of good corporate governance principles, and the role of DPS in the application of sharia compliance in BPRS in Central Java and Yogyakarta. This study produced three findings. First, the BPRS in Central Java and Yogyakarta in applying sharia compliance ran their activities free from usury, gharar and maisir, with lawful business activities by managing the zakat in accordance with sharia. However, there was a contract that did not meet the sharia because it contained elements of usury, gharar and maisir, depending on the point of view, namely the financing agreement of mudarabah and musyarakah because of the division for the income based on revenue projections and not actual revenue. Second, the practice of good corporate governance principles in the BPRS in Central Java and Yogyakarta was to implement transparency, accountability, responsibility, professional and fairness. Third, the role of DPS in the application of sharia compliance on the BPRS in Central Java and Yogyakarta was giving direction and understanding on sharia compliance, overseeing and evaluating the implementation and conducting dissemination and education on Islamic banks to the public. This research in Islamic economics was included in the study of muamalah or Islamic economic law. The application in Islamic banks should be coupled with the application of sharia compliance in which the supervision is conducted by the DPS. Islamic banks in operation require good management to implement transparency (tabligh), accountability (amanah), responsibility mas’uliyyah), professional (fatanah) and fairness (‘adalah). One of the principles of Islamic economics is khilafah which means managing and regulating well (good governance). In managing Islamic financial institutions, the management should apply the principles of nubuwwah (imitating the properties of the Prophet), as tabligh (transparency), amanah (accountability), mas’uliyah (responsibility), fathanah ( professional) and ‘adalah (fairness) that all these properties are properties in khilafah. principle. The properties are in accordance with the principles of good corporate governance which include transparency, accountability, responsibility, professional and fairness. Thus, the application of the five principles of GCG on BPRS in Central Java and Yogyakarta was in line with one of the principles of Islamic economy above, i.e., khilafah. The contribution of this study is therefore to support the principles of khilafah which is one of the principles of Islamic economy.
