Abstract

The Indonesian nation was blessed by the Almighty God in the form of abundant natural resources, both in water, on land and in the air. One of these natural resource wealth is the animal. The animals in Indonesia are very numerous, but Indonesia cannot protect the animals they have, which causes the animals themselves to be threatened with extinction. One of the main factors threatening the extinction of the animals themselves is hunting for trade. Various types of protected and endangered animals are still traded, one of them in Yogyakarta. In fact, there are rules that prohibit the trade of protected animals, which are regulated in Law Number 5 of 1990 concerning Conservation of Biological Resources and their Ecosystems. This law is the basis for the enforcers of the Natural Resources Conservation Agency of Yogyakarta (BKSDA) and The Detective Directorate for Special Crime (Ditreskrimsus) Regional Police of Yogyakarta to carry out their duties in handling the case of protected wildlife trade in Yogyakarta. Departing from this background, the authors question how the law enforcement is carried out against the trade crime of protected animals in Yogyakarta and whether in law enforcement against the crime of trafficking of protected animals is in accordance with the provisions of the legislation. This study uses field studies, namely by obtaining data from interviews, observation and recording of trade data of protected animals in the Yogyakarta BKSDA and Ditreskrimsus of Yogyakarta Regional Police. The approach in this study uses an empirical juridical approach. The nature of this study uses analytical descriptive, which is describing and analyzing the events that occur in the process of enforcing the trade law of animals that are protected in the Yogyakarta BKSDA and the DIY Police Regional Police. Based on the results of research and data analysis that has been carried out, it can be concluded that law enforcement against the trade crime of protected animals in Yogyakarta is carried out by means of prevention and repression. Law enforcement by means of prevention is carried out by PPNS BKSDA and the Police of Ditreskrimsus DIY Regional Police by way of socialization to the community and carrying out guards and patrols. Meanwhile, law enforcement by means of repression is carried out by law enforcement officers of PPNS BKSDA and the Police of Ditreskrimsus Yogyakarta Regional Police by bringing the perpetrators of criminal acts of trade in protected animals into the applicable judicial process. And law enforcement against protected wildlife trafficking, which is carried out by PPNS BKSDA and Ditreskrimsus in Yogyakarta Regional Police in accordance with existing regulations, namely Law Number 5 of 1990 concerning Conservation of Biological Resources and their Ecosystems and Law Number 8 of 1981 concerning Criminal Procedure Law.
