Abstract

Sand dune is a mound of hills from sand blown by the wind. Sand dune can be found in areas that have sand as the main material, high wind speeds to erode and transport sand-sized grains, and surface soil for deposition of sand, usually forming in dry areas. The Parangtritis Sand Dune Area has an area of 413 ha, consisting of a core zone of 141.5 ha, a restricted zone of 95.3, and a supporting zone of 176.6 ha. Sand dune has an area of approximately 90 hectares, around 40 hectares are owned by local residents. However, the 40 hectare land that has been buried by sand is claimed to be owned by Sultan Ground (SG). The villagers disagreed with the claim, and finally the residents and village officials began to re-measure the sandbanks to find out the boundaries of the land. However the effort has not yet reached its maximum, because often many residents protest about it because it is not as expected. So that an unclear ownership conflict arises. This research uses field research methods, namely by collecting data, extracting data and through interviews with informants from relevant agencies, processors, and the community. The research approach in this issue uses the socio, juridical and normative approach, which is an approach by looking at the phenomena in the field regarding the perspective or knowledge of the community about what it is doing. The juridical approach is based on the provisions of the applicable law, while the normative approach is based on Islamic law. In positive law, customary law and Islamic law of citizens only have the right to use by opening land in the area with the permission of local authorities and the Sultanate. In this case the agency or the State (holders of land rights) to use the land properly. For individuals or groups who want to use the land must pay attention to and follow the applicable rules and every citizen who wants to have land rights must comply with applicable regulations. It is expected that the community and the local government will cooperate with BUMDes (village-owned enterprises) in terms of promoting the economy in the region.
