Abstract

Law is a tool used to establish pulic order, is binding and coercive. However, public order wich is the purpose of the law will only be achieved if the exiting theory in law is in accordance it’s the reality in society. Include terms of economic and business. Design and editing services are one of the business that are in great demand by students. With the economic conditions that are still limites, most student providing design and editing services choose to use cracked software as a production tool. Even the ban on this matter is contained in the Copyright Act number 28 of 2014. This research is a qualitative research with analytical descriptive approach and deductive analysis method. While the approach use is legal psychology and maqāṣid al-sharī‘ah. The psychology of law result from of this study conclude that the cause of violations of the use of cracked software by some students of editing and design services is individual factor contains factors forming individual behavior, environmental, and environmental interaction factors. Public views are also factor that support violation behavior. Meanwhile, according to the maqāṣid al-sharī‘ah, this violation cannot be justified even though the students providing editing and design services do not have venture capital, because it is not in accordance with the principles of sharī‘ah economics and violates the hifdzul māl concept.
