Abstract

Compensation for goods delivery services is a legal relationship between service providers and service users. Service provider agreements to service users serve as guidelines in all forms of binding law between the two. Because service users have fully entrusted the service provider to help distribute the goods to be distributed, this is the basis for legal certainty between PT.Pos and users of goods delivery services. Of course, there is a risk when when the goods are delivered, there is a delay, damage or loss of goods when in the process of distributing the goods from the place of delivery to the destination, so the need for regulations governing the compensation system as a legal umbrella between the two parties. PT.Pos has issued a Decree of the Board of Directors Number: KD.128 / DITRAKET / 0616 which also regulates the compensation system for compensation for PT.Pos service users in the event of a default. However, it is necessary to have harmony between the Directors Decree issued by PT. Heading with applicable laws related to compensation, and in accordance with Law Number 12 of 2011 concerning the Formation of Laws and Regulations. The problem is that the compilers describe using normative juridical research methods, reviewing and discussing the object of research from the legal side, which data is obtained from the statute approach (statue approach) and the conceptual approach (conceptual approach). This research is prescriptive in nature, which assesses the decision of the Directors of PT. The Magelang Branch Post regarding Compensation for Lost / Damaged Packages from the point of view of laws and regulations related to consumer protection. Compilers review and discuss the object of research from a legal side: primary data is obtained from the case approach and examines from the side of the Law and Legislation , secondary data is obtained from research journals. The results of this study indicate that there are still losses to service users regarding the compensation system. As in Article 3 paragraph (3) Decree of the Board of Directors of PT. Pos Indonesia (PERSERO) Number: KD.128 / DITRAKET / 0616 concerning Guarantee for Compensation for Domestic Letters and Packages, states: Compensation Guarantee applies to types of Pos Express services, special express mail, express post, on this basis that it can be seen how PT. Pos makes exceptions in other points but also gives a picture as if PT. The post will make compensation to all service users of PT. Post. In addition, service users do not know anything or do not understand the contents of the compensation system clause, therefore it can be canceled or canceled by law. Because the contents of the Board of Directors' Decree regarding compensation are not in accordance or not in accordance with the applicable Law or above, and this has violated the provisions of the making of laws and regulations in force in Indonesia.
