Abstract

Pulsa is a means of payment for communication used on mobile phones for SMS or telephone services. In Indonesia, at the beginning of the entry of mobile phone service providers, there were very few pulsa providers, because the existing telecommunication tools, namely landlines, did not use pulsa. As the development of mobile phones is increasingly enjoyed by the community, providers provide pulsa products in order to support the use of means of payment for communication via mobile phones. Here the emergence of pulsa agents as a new business with a booming interest in purchasing pulsa causes the transactions that occur between distributors and agents to have irregularities regarding the unclear price of pulsa and price increases, so there are defects in buying and selling goods. In this research, it only examines the price uncertainty that occurs between distributors and agents which results in fāsid sale and purchase transactions, compilers observed between several distributors and pulsa agents in Yogyakarta. This type of research is field research and the method used by the writer is qualitative research methods, it is the type of research whose data are obtained from observations and interviews with distributors and agents in the Sleman district as well as researchers try to describe a certain situation that is factual in a systematic and accurate manner. Based on the results of the research, the authors concluded that in general the transaction of buying and selling pulses between distributors and agents has elements of garar and maisi>r, because the distributor does not provide a unit price for pulses and does not notify the pulsa price increase so that the quality and specifications are not clear including fāsid, but the transaction is still allowed as rukhs}ah (relief) and special dispensations for business people so that the contracts that occur to distributors and agents include valid contracts that are permitted on a 'urf basis, for an increase in pulse prices, distributors and agents have known that there will be an increase but do not know when it will occur, insignificant so that it does not affect the selling price of pulses and does not cause a dispute between the two. then the credit transaction between the distributor and the agent is legal.
