Abstract

The opening of the 1945 Constitution paragraph 4 affirms the obligation of the state to protect the entire nation and all spilled blood that includes the environment. To optimize the protection and management of the environment is required community participation as affirmed in Law No. 32 of 2009 in which is regulated licensing in the tourism business sector through TDUP which at the regional level of West Java Province is regulated by Regional Regulation No. 2 of 2016 on Guidelines for Control of North Bandung Area as a Strategic Area of West Java Province. Based on the legislation, community participation is an important aspect in the scope of licensing and environmental management and protection. From January to March 2020 there was a rejection of noah's park agrotourism development by the community, through @lembangnews instagram account and petition on the change.org page which garnered 4,148 votes. From the question arises the question: first, how does the community participate in the issuance of agrotourism development permits Noah's Park? Second, is the participation of the community in the issuance of permits in the development of Noah's Park Agrotourism in accordance with the principles of good governance? The research method used by the compiler is library and field research. The authors of this study used primary data in the form of interviews and secondary data in the form of books, journals, documents, online and non-online magazines, as well as tertiary data in the form of encyclopedias and dictionaries. In addition, it uses legal materials in the form of laws and regulations and principles of good governance. Using empirical and juridical approach, by looking at the implementation of community participation in controlling the utilization of KBU space in the development of Noah's Park Agrotourism which is then adjusted to the prevailing laws and regulations. The results of this study concluded that the process of community involvement is carried out through socialization from the regional government through the approval of neighbors, as well as invitations to meetings attended by the community or represented by the Regional Government and related Agencies through the process of discussing Environmental Studies. The form of community participation in the process of issuing Noah's Park Agrotourism Development permits in the view of John Gaventa and Valderrama, can be positioned as information participation. The principle of good governance as a sign of every government action has not been fully implemented by the government. The form of information disclosure, as well as the participation of the government in the process of issuing permits should develop a pattern of deliberative democracy that prioritizes between ideas and between parties.
