Abstract

The Indonesian Consumers Foundation (YLKI) in 2017 provided data on consumer complaints in buying and selling online, namely from 642 complaints in general. Starting from January to November 2017, YLKI released data on complaints of 101 online shopping complaints, or 16% of total complaints in general.Based on this data, the highest complaint was addressed to Lazada.co.id as one of the popular market places in Indonesia. Based on these problems, consumer protection is a subject that needs to be studied, both in terms of security guarantees provided by e-commerce to the effectiveness of the Consumer Protection Law as a reference for every consumer. Therefore this research aims to check e-commerce security system Lazada.co.id in guaranteeing consumer rights, and at the same time to check consumer protection in positive law based on the perspective of Islamic law. This type of research is library research (library research). The approach used in compiling this research is a normative juridical approach, namely legal research which is carried out by examining library materials or secondary data as the basic material for research, by conducting a search of the regulations about the problem under study. This research can be concluded as follows: 1) Lazada.co.id has made efforts for consumer protection, namely by providing written rules in the Terms and Conditions of Service Use (term of use). Although in the term of use Lazada.co.id has sought consumer protection, researchers have found several weaknesses that have the potential to make it easier for someone with bad intentions to use the Lazada.co.id platform by using invalid personal data. Another weakness is the imposition of conditions on returning goods, where Lazada.co.id sets several criteria for items that can be returned (return), this limits consumers in demanding replacement goods because they are bound by conditions that must be met first. 2) Law Number 8 of 1999 about Consumer Protection (UUPK) and Islamic Law both strive to give protection for consumers, however in the UUPK there are limitations to consumer protection such as in matters of jurisdiction, and limited time for the responsibility of business actors. however, this limitation does not apply in Islamic law as long as it can be proven that it is true that the business actor has made a mistake. Based on this, consumer protection in Islamic law can cover the shortcomings of the applicable consumer protection laws. however, this limitation does not apply in Islamic law as long as it can be proven that it is true that the business actor has made a mistake.
