Abstract

This thesis examines the Legal Politics of the Establishment of Yogyakarta City Regional Regulation Number 2 of 2017 concerning Non-Smoking Areas from the Perspective of Siyāsah Dusturiyyah. This study aims to examine how the legal politics of the formation of Yogyakarta City Regional Regulation Number 2 of 2017 concerning No-Smoking Areas and how is Siyāsah Dusturiyyah's perspective on Yogyakarta City Regional Regulation Number 2 of 2017 concerning No-Smoking Areas ?. This type of research is normative legal research with a statutory approach (statutory approach. The type of data used in this study is legal material consisting of primary (statutory), secondary (books, journals) and tertiary (dictionary) legal materials. English-Indonesian) Data analysis method used is descriptive-analytic and data collection using library research (library research). The results of this study illustrate, first, that the formation of Yogyakarta City Regional Regulation Number 2 of 2017 concerning No-Smoking Areas is colored by the political configuration by the Pros and Cons of the Yogyakarta City DPRD and the Yogyakarta City government so that it takes quite a long time to enact these regulations. The political configuration that occurs in the formation of the Perda is a democratic political configuration that uses deliberation to absorb the various aspirations of the community. Second, the Yogyakarta City Regional Regulation Number 2 of 2017 concerning Non-Smoking Areas is substantially in accordance with the principle of siyāsah dusturiyyah which prioritizes Islamic values and basic human rights such as providing certainty, equality and legal justice for the community by maintaining mental health at the same time. regulating the socio-economic activities of the community so that life can run well.
