Abstract

This thesis raises two problem formulations, namely: 1) how is history constitutional limits on the term of office of the President and Vice President that apply in Indonesia? 2) What is the idea of a term of office for the President and Vice President in Indonesia from Sadd az\-Z|ari@‘ah perspective? Question First, regarding the constitutional history of term limits in terms of aspects historical course of term limit regulations that have been in effect at Indonesia, from the beginning of independence until now. While the second question the author describes the idea of a presidential term with a perspective Sadd az\-Z|ari@‘ah. This research is a qualitative research, using normative, historical, and conceptual approaches. While in terms of studies, This research uses literature review. To strengthen existing data, This research relies on data from books, journal articles, and sources other literature. The results of this study are, Article 7 of the 1945 Constitution prior to amendments valid from 1945-1999, in this case the President's term of office is not limited and open up opportunities for a President to serve continuously. Article 7 The 1945 Constitution after the amendment provides confirmation regarding the periode the positions of President and Vice President and a President are only limited served two terms. The idea of one term of office of the President and Vice President is reviewed from Sadd az\-Z|ari@‘ah aims to benefit, and prevent from congestion. When compared with the terms of office of the President and Vice President for two terms, the maslahah will be more, because of the first position period can make a President more concentrated in running position, does not abuse authority, and there is no term incumbent in the process of selecting the President and Vice President.
