Abstract

Phintraco securities Yogyakarta is one of the branch offices of Phintraco securities which is a securities company as well as a member of the Indonesia Stock Exchange (IDX). As one of the securities companies with the most customers in Indonesia, Phintraco Securities has contributed to the development of sharia stock trading by issuing a sharia online trading system (SOTS) investment service product known as Profits Syariah. This study was conducted with the aim of describing stock trading practices through SOTS at Phintraco Sekuritas Yogyakarta and analyzing the application of sharia principles to stock trading practices carried out by SOTS customers at Phintraco Sekuritas Yogyakarta, one of which is not doing gharar transactions. This type of research is empirical legal research or also known as field research. The nature of this research is descriptive-analytical using a normative approach. This research data collection uses interview techniques and uses qualitative inductive methods as a technique in analyzing research data. The results of this study can be concluded that the practice of stock trading through SOTS at Phintraco Sekuritas Yogyakarta is in accordance with sharia principles based on DSN MUI Fatwa No. 80/DSN-MUI/III/2011 concerning the Application of Sharia Principles in the Mechanism of Trading Equity Securities in the Regular Market of the Stock Exchange. However, in the practice of stock trading carried out by Sharia Profits customers at Phintraco Sekuritas Yogyakarta, there are still gharar transactions. This is because the consideration of using instincts made by the customers of Profits Syariah Yogyakarta has fulfilled two of the four elements of gharar. The consideration of using instinct is only carried out by novice customers, which is different from old customers who have used considerations with stock analysis techniques and have applied sharia principles in conducting stock transactions through Sharia Profits at Phintraco Sekuritas Yogyakarta.
