Abstract

The husband and wife relationship in the household has rights and obligations that must be fulfilled. Islam is very concerned about the rights and obligations of husband and wife with the aim of creating an eternal and happy family. Underage marriages are marriages carried out by people who are still young and are very vulnerable to disputes and even divorce, because the rights and obligations of husband and wife in marriage are not fulfilled. In fact, in Sewon Subdistrict, Bantul Regency, there are still perpetrators of underage marriages that are not in accordance with the provisions stipulated in Law Number 16 of 2019 concerning Amendments to Law No. 1 of 1974 concerning Marriage. With this the authors are interested in studying the reasons for the occurrence of underage marriages carried out by married couples in Sewon District, Bantul Regency, underage marriages affect the attitude of couples in fulfilling the rights and obligations of husband and wife and the influence of underage marriage age on the forms of rights and obligations husband and wife. In this study, the authors used the field method (field research). With this research, the authors came to the location or house to observe underage marriage couples in Sewon District, Bantul Regency. In addition to observational observations, the authors also conducted interviews with several parties related to this issue, such as the Head of the KUA Sewon District, the perpetrators of underage marriages and the parents of the perpetrators of underage marriages. The approach used in this study is a sociological juridical approach, which is to see social phenomena in society which are then linked to the applicable rules. In this case, the phenomenon of underage marriages carried out by married couples in Sewon District, Bantul Regency which still often occurs. With this phenomenon associated with the applicable rules, these rules should be able to respond to the times, especially in the phenomenon of underage marriage and how these rules have a check and balance function in managing people's lives so as to create the desired environmental order in this case in relation to fulfillment of the rights and obligations of husband and wife in underage marriages. This study reveals that first, the reasons married couples in Sewon District, Bantul Regency conduct underage marriages, namely pregnancy outside of marriage, efforts to perpetuate relationships and the inability of parents to educate. Second, underage marriage affects the attitude of underage married couples, it can be seen from several aspects, namely aspects of economic fulfillment, fulfillment of housing, fulfillment of taking care of and educating children and biological fulfillment. Third, the influence of the age of underage marriage on the form of fulfillment of the rights and obligations of husband and wife can be seen from several aspects, namely aspects of the reasons for underage marriage and husband's v work, aspects of the age of the two couples who are underage or related to the maturity of underage marriage partners and environmental and social aspects
