Abstract

This paper is a study that aims to analyze the fatwa of Indonesian Ulema Council (MUI) on the practice of implementing BPJS kesehatan Social Security which is focused on analyzing the MUI fatwa on BPJS Kesehatan and the isṭinbaṭ method used by MUI making fatwa. This type of research is a descriptive qualitative research, which is a study that seeks to describe and describe the data obtained, both primary and secondary data that have been obtained This study uses a library research approach, namely looking for sources of data obtained from literature studies and various kinds of literature that are in accordance with the discussion, including the study of the MUI fatwa and regulations regarding BPJS Kesehatan. The results of this study show that MUI uses bayani methods and terminological methods so that MUI gives fatwa of BPJS Kesahatan is not in accordance with Sharia principles. However, MUI gives the public leeway to continue to be allowed to use BPJS Kesehatan on the grounds of emergency and benefit of the people. This fatwa is also an encouragement from the MUI fatwa institution to the government to immediately create a BPJS Health system that is in accordance with Sharia principles.
