Abstract

The development of information technology has had a major impact on human life. These impacts have touched various lines, including in the field of transportation. Transportation or transportation is a very important field of activity in the life of the Indonesian people. Realizing the importance of the role of national transportation in an integrated manner and being able to realize the availability of transportation services that are in accordance with the level of traffic needs and transportation services that are orderly, comfortable, fast, smooth, and low-cost. Finally, in the administration of transportation, the phenomenon of online application-based transportation modes has emerged that targets the taxi transportation market. Its presence in several parts of Indonesia has also penetrated the city of Yogyakarta, especially the online taxi mode of transportation. Online taxi transportation in the city of Yogyakarta has brought a polemic regarding its legality as a public transportation vehicle. In addition, regarding control and supervision, where online taxi transportation can operate in the city of Yogyakarta. The Yogyakarta City Government, in this case the Department of Transportation, which has the authority to develop road transportation, needs to be investigated regarding its role in controlling and supervising online taxi transportation in the city of Yogyakarta. This research is a field research with an empirical juridical approach. The nature of this research is descriptive analytical, to describe, describe, and analyze the Yogyakarta City Transportation Service for efforts to control and supervise online taxi transportation in the city of Yogyakarta with a theoretical framework in the form of law enforcement theory or law enforcement and licensing theory. Data collection techniques in this research are in the form of field studies and literature studies. Field studies include direct observation activities, as well as in-depth and guided interviews with resource persons from the Yogyakarta City Transportation Office. Literature study is done by documenting documents and literature related to the research material. The results of the study indicate that the existence of an online taxi mode of transportation violates the State Administrative Law. Based on the State Administrative Law, relating to regulations (regeling) for the development of transportation operations, it is the authority of the Ministry of Transportation, the Department of Transportation and the relevant Regional Governments. The existence of discretion exercised by the president is goal-oriented, usefulness and usefulness (doelmatigheid), namely the purpose of implementing public interests, not necessarily enforcing its legitimacy or legality aspects (rechtmatigheid) because the government is aware that it has not been able to provide a safe mode of transportation that is the hope of the community, cheap, fast and affordable. However, the greater interest is to reduce unemployment and to create a more conducive atmosphere for the life of the nation and state, it is better for the government to continue to allow online-based transportation modes using the principle of benefit approach. The Yogyakarta City Transportation Service has not been able to carry out control and supervision considering that there are no regulations that are the basis for carrying out controlling and supervising online taxi transportation.
