Abstract

The aim of this study to determine whether the National Land Agency (BPN) has implemented the precautionary principle in the PTSL (Complete Systematic Land Registration) program in Gunungkidul Regency or not and to see the implications of land registration through the program. The formulation of the problem posed/proposed is whether BPN has applied the precautionary principle to the PTSL Program in Gunungkidul Regency and what the implications of Land Registration are in Gunungkidul Regency through the PTSL Program. The research uses a qualitative nature / method, where the data obtained using the method of analysis and theoretical basis must be in accordance with the facts in the field. The approach used is juridical empirical, in which this approach is used to analyze the extent to which the rules / laws apply effectively. The data obtained were through interviews at BPN Gunungkidul Regency, Playen Village, Padukuhan Bulurejo, and Terbah Village. The results of this study can be concluded that the application of the BPN precautionary principle in the issuance of land certificates in the PTSL program has been implemented properly, although there are still obstacles experienced such as unclear data collected by participants who participated in this program, incomplete data collected. , etc. In addition, BPN has also anticipated the existence of a GeoKKP (Koputerisasi Tanah) system, in which the system is used to determine the status of registered land so that certificates do not overlap. The PTSL program produces land certificates where this certificate provides legal certainty of ownership of land which can later be used as written evidence in the event of a land dispute.
