Abstract

The arrangement of compensation for victims of traffic accidents based on Law Number 22 of 2009 concerning Road Traffic and Transportation has not yet been explained in detail on how to resolve them, especially traffic accidents that cause fatalities if the case is not legally resolved. Like the case of a traffic accident that occurred in Klaten which was experienced by a grandfather named Pairo, the compensation provided by the crasher should not eliminate the criminal charges against him. This is reinforced by Article 235 of Law Number 22 of 2009 concerning Road Traffic and Transportation. However, the settlement of the case was only carried out peacefully by providing compensation in the form of money which had been agreed between the two parties and providing assistance in the form of basic materials to save death and escape from criminal punishment. This research on the mechanism for the settlement of compensation for victims of traffic accidents according to Law No. 22 of 2009 concerning Road Traffic and Transportation in Klaten Regency is expected to provide more rights for victims of traffic accidents that lead to fatalities. This research method is field research where this research is carried out by going directly to the field to find data and information needed to answer questions related to this research and interviews by conducting oral, written and structured questions and answers. In the technique of collecting data with field research, the author goes directly to the field to get the necessary data. This study uses empirical juridical data, in other words, this research method starts from analyzing a case and then looking for a solution through statutory procedures. The results of the study indicate that the provision of appropriate compensation to victims cannot be equated, economic position becomes an important point in determining the amount of compensation given to victims. The regulation regarding compensation in Article 235 of Law Number 22 of 2009 concerning Road Traffic and Transportation explains the status of the related party in a traffic accident criminal case after giving compensation to the victim or his heirs who do not suffer a miscarriage. Civil cases for compensation can be resolved through family channels, but criminal cases will still be processed by the police. The police have no right to interfere and pressure both sides. The police also cannot side with only one party involved in the problem of traffic accidents. The most important resolution of accident cases is to find both parties and mediate so that the mediation results will find the principle of benefit between the two parties. If the path of peace or kinship is more considered beneficial, then a case will not proceed to court.
