Abstract

For protect the citizens of Republik of Indonesian, the government Republic of Indonesia's already issued rules on the prohibition about trading Import used clothes. Between the rules is Article 47 paragraph 1 and Article 50 paragraph 1, Law No. 7 of 2014 on trade, then regulation of the minister of trade No. 51/M-DAG/PER/7/2015 on prohibition of Import of used clothing. And also in Article 8 paragraph 2, in Law No. 8 of 1999 on Consumer Protection. Although there is a ban on buying and selling import used clothing, to the point, the trade transaction of Used Clots in the Squat Market still remains until now. In this research, writer investigate why trade of used cloth still remain until today? In this research, the writer used the qualitative research,the method is field research with interview and observation with part who relate with this research, to explore information on why the practice of Trading imported used clothing still remains untill today. In this research writer use analysis, with sociological of law. Based on the results of the research shows that the transaction of trading used cloth in the Squat Market, still remains until now is due to the number of sellers and buyers who do not know the rules of prohibition on trading imports used clothing. Moreover, it is due to economic considerations; for traders, the capital required for imported used clothing is not large and the results are quite profitable. Even so for buyers of used cloth, buy used clothes or thrifting, can get a more expensive price , than buying in new conditions the price can be very high, and also consumption behavior the buyyer.
