Abstract

Act Number 11 of 2020 concerning Job Creation is one of the public policy agendas that has changed several provisions in 79 laws which are classified into several sectors. The government administration sector is one of the clusters that amends two laws, namely Act Number 23 of 2014 concerning Regional Government and Act Number 30 of 2014 concerning Government Administration. The two laws can be said to be the heart of the authority and the relationship between the Central Government and the Regional Government. In the context of a state of law that accommodates guarantees for the protection of human rights, these changes of course also lead to different models of guaranteeing the protection of human rights. Therefore, this research answers several problem formulations, namely: (i) does the Government Administration sector in Law Number 11 of 2020 concerning Job Creation provide guarantees for the protection of human rights?; and (ii) based on the concept of siyasah idariyah, what should the regulatory model in the Government Administration sector be to provide more guarantees for the protection of human rights? In order to answer the formulation of the problem, the legal material used in this research is legislation which is placed as the primary legal material. Then, literature such as books, journals, scientific works, reports, and articles are used as secondary legal materials, and the primary legal materials used are dictionaries and encyclopedias. Furthermore, the research uses a juridical-philosophical approach. Thus, this research can be categorized as library research. Provisions in the administrative sector have the potential to create anomalies when faced with the issue of guaranteeing the protection of human rights. These anomalies are: (i) narrowing openness, public participation space, reduction of work procedures, relationship patterns, and government accountability; (ii) distortion of the right to legal certainty; (iii) potential abuse of discretion. Therefore, the provisions in the government administration sector need to be reconstructed. The reconstruction alternatives are in the form of: (i) returning the provisions of "not contradicting the provisions of the legislation" as a condition of discretion; (ii) include a clause that can be interpreted as a form of accommodation for the spirit of regional autonomy; (iii) restore the PTUN's authority to examine, hear, and decide cases of positive fictitious applications.
