Abstract

The increasing variety of human needs requires consumers to make quick decisions that impact the behavior of consumers to buy products online. One of the most popular online shopping platforms in Indonesia is Shopee. Although consumer rights have been protected by the government through Law number 8 of 1999 on Consumer Protection (UUPK) and Law number 11 of 2008 jo. Law number 19 of 2016 on Information and Electronic Transactions (ITE Law) and the providers have guaranteed consumer rights through electronic contracts, there are many cases of consumers who get losses on product. Consumers often get items which is not as expected due to consumers who can not come face to face because it only capitalizes on trust so it can cause losses. The purpose of this research is to find out the rights that must be obtained in accordance with the model of losses experienced by Shopee consumers and the responsibility of businesses to consumer losses Shopee. This type of research is field research with a juridical-empirical approach. The nature of this research is descriptive analytics. Data collection techniques in this writing are obtained by means of interviews and literature studies. Data analysis uses qualitative analysis methods and draws deductive conclusions. The results showed that: First, although Shopee as a provider already has regulations on terms of service and community regulations, the implementation of Shopee consumer rights obtained based on the model of losses experienced by Shopee consumers has not been fully fulfilled. Second, the form of liability of businesses to consumers for losses of goods that are not in accordance with those obtained by Shopee consumers is fully regulated in the Terms of Service through the "Resolution Center" feature. However, there are still many sellers who are not responsible for arguing to blame the delivery service and even ignore complaints from consumers. There are still sellers in Shopee who do not comply with the rules in the Terms of Service because they do not have good faith to be responsible for providing compensation.
