Abstract

In early 2020, all countries in the world including Indonesia were shocked by the emergence of a virus known as Coronavirus diseases 2019 or Covid-19. This incident makes community activities become limited after the new normal which means having to comply with health protocols is no exception in running the government. All elements of government must comply with the use of health protocols in carrying out their duties and obligations. The prevailing laws and regulations are deemed less relevant when used in a health emergency situation as it is today. During this pandemic, effective and efficient steps are needed in criminal settlement by complying with health protocols, especially at the stage of investigations that are directly related to the community. In this case, a new regulation is needed that has been adjusted to the current situation and can be implemented properly by either the police or the community. Therefore, the compiler is interested in researching the investigation policies during the Covid-19 pandemic at the Yogyakarta Special Region Police. Research conducted by compiler using field research methods by using the nature of descriptive analytic research to obtain objective research results. The compiler clearly describe the policy investigation during the Covid-19 pandemic along with the implementation and obstacles experienced during their duties, especially in the jurisdiction of the Yogyakarta Special Region Police. Then carried out an in-depth analysis with an empirical juridical approach which aims to study the data in the field based on the results of interviews and observations with applicable legal provisions. The analysis is related to the legal political theory to see the background of the policy making and its KUHAP or the Indonesian National Police Law and discretionary theory in the form of alternative actions that may be taken by investigators in settlement a criminal act. The results of this study indicate that the Yogyakarta Special Region Police did not issue a written policy regarding investigations and investigations during the pandemic, but only a form of elaboration and implementation of the Telegram Letter issued by the Indonesian National Police. Basically the form of policy implemented by the Yogyakarta Special Region Police is only around the application of health protocols in the work environment, but has a more specific description so that it is easy for all. This policy still has obstacles in its implementation, namely the time for completion of a crime which requires relatively longer time, lack of freedom in carrying out their duties, consultations between lawyers and suspects are not optimal, and lack of awareness. from the community in implementing health protocols. However, the public can tolerate the existence of new policies during the pandemic and have made the use of health protocols as a lifestyle in daily life.
