Abstract

Consumer protection in Indonesia has been regulated in Law Number 8 of 1999 concerning Consumer Protection. However, the implementation of this law still needs improvement. One of the unanswered problems with the existence of this law is the fulfillment of student rights as consumers. The law already regulate consumer rights in general, but there are still massive cases of food poisoning with student victims, as if it shows that the guarantee and fulfillment of children's rights guaranteed in Law Number 8 of 1999 have not been able to accommodate these problems. The fact is that children are weak and vulnerable legal subjects, and snacks in the school environment play a role that is quite consequent in their energy intake and fulfillment of nutrition. So that in addition to the need for preventive efforts, there is also a need for arrangements that can accomodate the rights of children as consumers, because of course children as consumers and adults cannot be treated equally. This study used a juridical-normative legal research method, using a statutory approach (Statute Approach) and data collection techniques with literature study. The compilers describe consumer protection according to applicable positive laws clearly. The author's analysis used the theory of legal protection and consumer protection, the results of the analysis are presented descriptively and analytically. The results of this study indicate that Law Number 8 of 1999 concerning consumer protection has answered the fulfillment of consumer rights comprehensively. However, it has not yet accommodated the fulfillment of children's rights as consumers, even though there are many other legal instruments that oversee the fulfillment of children's rights as consumers to maintain their growth and development. Then Law Number 8 of 1999 concerning Consumer Protection has not been able to guarantee the fulfillment of children's rights in obtaining healthy food for consumption especially in the school environment, because the law does not specifically regulate child consumers. Children's rights are part of human rights that must be protected and fulfilled. So in order for this to be implemented, it is necessary to harmonize laws and regulations between Law Number 8 of 1999 concerning Consumer Protection, Law Number 23 of 2002 concerning Child Protection, and other laws.
