Abstract

Pancasila and the 1945 constitution as the basis of the philosophy that upholds the will of respect and protection of human rights, be logical consequences for Indonesia to uphold and advance the protection of human rights in the state of the domestic, as well as in the manufacture of regulation. The reform of the regulation of the labor that produces the law of copyright work which changed 79 the Law including the UU No. 13 tahun 2003 (UU Ketenagakerjaan). Protection and enhancement of the rights of workers in industrial relations is a problem that is not over-done. In fact, it is the duty of the state in ensuring the protection and enhancement of the rights of workers. This study has two formulation of the problem. First, how is the protection of the rights of workers in the UU Ketenagakerjaan and theUU Cipta Kerja. Second, how the comparative analysis of the rights of workers between the two laws the terms of human rights. The research method used is normative juridical with the compare between UU Ketenagakerjaan and UU Cipta Kerja.This research resulted in the conclusion. As a conclusion, the rights of workers in the Ketenagakerjaan in general is better than on the UU Cipta Kerja. It can be seen in the settings related to outsourcing, PKWT, Severance, Wage and mechanism oftermination of employment. Conclusion furthermore, viewed from the right ekososbud, setting workers ' rights in the UU Cipta Kerja is not in accordance with the principle of fulfillment forward as the responsibility of the state in accordance with the mandate in the Covenant rights ekososbud.
