Abstract

The phenomenon that is developing in the community today is the application of the customary law version of the land pawn system. In practice, the land pawning system based on customary law knows no time limit, so that the land pawn agreement can last up to a dozen years. Like the land pawning that developed in Bangunkarya Village, which still uses customary law as a rule. In Bangunkarya Village, there are still many land pawn agreements that have been running for more than 7 years. This is of course contrary to the provisions of Article 7 of Law Number 56 Prp of 1960 concerning Determination of Agricultural Land Areas which regulates the return and repayment of pawned agricultural land. So the authors are interested in studying the implementation of agricultural land pawning in Bangunkarya village after the enactment of Law Number 56 Prp of 1960 and obstacles in its implementation. This type of research is field research and library research. This research is descriptive analytic. The approach used in this study is an empirical juridical approach. In the data collection method, the authors use the method of interviews, observation, literature studies, and other sources related to this research. The theories used in this research include the Legal Certainty Theory, Agreement Theory, Land Pawn Theory according to Customary Law, and the Legal System Theory according to Lawrence M. Friedman. The results of this study conclude that the practice of pawning agricultural land in Bangunkarya Village after the enactment of Law Number 56 Prp of 1960 still uses customary law as the rule of law. The main factor that became the reason for the people of Bangunkarya Village to carry out pawn transactions for agricultural land was due to an urgent need factor (economic factors). The majority of the people of Bangunkarya Village still use unwritten agreements (verbal agreements) and do not specify a detailed redemption period in agricultural land pawn transactions. One of the characteristics of the practice of pawning agricultural land based on customary law is that the right to redeem cannot be expired. This is also found in the practice of pawning agricultural land in Bangunkarya Village, so that there are still many practices of pawning agricultural land that have been going on for more than 7 years and the land being pawned is still in the possession of the pawnee because it has not been redeemed by the land owner. This then made the implementation of land pawning in Bangunkarya Village contrary to the provisions of Article 7 of Law Number 56 Prp of 1960. Factors that become obstacles in the implementation of agricultural land pawning in Bangunkarya Village are: First, the factor of the absence of socialization of Law Number 56 Prp of 1960. Second,Community Cultural Factors. Third, the factor of inconsistent law enforcement.
