Abstract

The forex is a type of trade or trade that trades the currency of one country against another. Investing in the foreign market on valuta would be most advantageous when a clever trader would analyze and play it, but not prevent the trader from experiencing considerable losses as invested. Most advertisements or offers on forex trading are so lucrative that people are attracted and give no thought to the possible risk losses, and there are still plenty of traders on the part of brokers who lack the most able quality, even using those forex as a fraudulent device within the study. This type of assessment is library research, research is descriptive, the study is analytic, the approach to the study uses a jurisdictional approach. In this case the author analyzes systematically a source related to the research object ruling out Tanjung Pinang court number 107/Pid.Sus/2013/PN.Tpi and Padang Panjang district attorney number 26/Pid.B/2018/PN.Pdp Research results on forex investment rulings 107/Pid.Sus/2013/PN.Tpi and 26/Pid.Sus/2018/PN.Pdp. However, in the theory of enforcing criminal law, the judge has not yet upheld the value of justice by not using the maximum sentence on article 378 of the penal code 4 years in prison, the writer judges judges out the sentence of 1 year 6 months in the first case and 3 years in the second case when the total cost paid by the victims in the first case exceeded one trillion and six hundred billion in the second.
