Abstract

On August 16, 2019 in a joint session of the DPD RI and the DPR RI, in the Plenary Meeting Room, Nusantara MPR/DPR/DPD RI Building, President Joko Widodo delivered a state speech and confirmed the plan to move the state capital (IKN) from Java to Kalimantan Island. . The reason for moving the IKN is because of the burden of Jakarta, which the value is unable to become the center of government. This reason is based on the fact that currently Jakarta, which is an IKN, has experienced many natural disasters. On the other hand, the reason is for equal distribution of the economy so that it can change the mindset from Java centric to Indonesia centric. However, behind the IKN transfer policy, what should be discussed in this policy is what impact it will have on the IKN transfer plan. Because, the various problems that exist in DKI Jakarta are the result of human hands themselves. In this issue, the author is interested in examining what impact will occur if the IKN plan is implemented which will then be investigated using the Maslahah Mursalah concept. Maslahah Mursalah itself means something that is good according to reason with the consideration of being able to realize good or avoid bad for humans. What is good according to reason, is in harmony and in line with the objectives of shari'a in establishing Islamic law, whether there are no specific instructions that reject it, nor are there any shari'a instructions that acknowledge it. This type of research is library research, where the data used is library data such as books, journals, documents or websites. The method used is descriptive qualitative research and tends to use analysis which then includes specific variables such as political, economic and environmental aspects so that at the end it will be examined using the concept of Maslahah Mursalah. The results of this study conclude that the implications or impacts of the plan to relocate the national capital are not in accordance with the terms and objectives of the Maslahah Mursalah concept, which is to bring good or stay away from evil. This is because the currently selected IKN location has also experienced environmental damage such as flooding, air pollution, water pollution, forest fires, lack of green open space, to threats to flora and fauna. When viewed from the political aspect, the policy for the transfer of IKN is issued at the end of office or before the presidential election so that it has a political message to continue the second term of leadership, there is no law on the transfer of IKN, the interesting thing is that the government has formed an Investment Management Institution or SWF through the Job Creation Law to attract foreign investors to invest in new IKN. In the economic aspect, it is estimated that there will be economic development in IKN. This means that there is no economic development in other regions.
