Abstract

Buying and selling share in jar products is to divide the contents of a product into several small containers. The share in jar system requires the product to be removed from its packaging, then transferred to another package. The rise of skincare that is being sold today is a product that is large or intact and makes consumers reluctant to buy because the products are large and quite expensive and it is feared that the purchased skincare products are not suitable and cause irritation. Finally, business actors took the initiative to sell skincare products in the form of share in jar packaging. From these various benefits, problems arise that make the product unclear because consumers do not see firsthand how the process of transferring it from the original packaging to the share in jar packaging, product condition, hygiene, the desired dose to the product that is requested, in other words is still rampant. The research that the author does is field research, which is a study that aims to obtain data or information about something with the original state in the field. Primary data was obtained by interview method and secondary data was taken from books, theses, journals, internet. The method of analysis in this study is a qualitative descriptive method. While the method of data collection using interviews and documentation. The results of this study indicate that the practice of buying and selling skincare products in share in jar packaging (1) consumers must bear the risk when buying share in jar products online because they cannot see firsthand how the process of moving from the original packaging into the share in jar packaging. (2) the three shops (lucybeauty, myalfabeauty, lovecheapshop) have not fulfilled the rights of consumers as stated in article 4 and article 7 of the Consumer Protection Law regarding the obligations of business actors, but it is not entirely the fault of business actors, sometimes consumers are also less careful because they do not pay attention to the terms and conditions that have been set. included in the description as stated in article 5 of the Consumer Protection Law regarding consumer obligations. (3) the sale and purchase transaction of the share in jar system at the online store above is not in accordance with Islamic law because it does not fulfill the element of khiyar rights and one of the objects is not clearly known for its quality and quantity. (garar).
