Abstract

This thesis examines the opinions of scholars regarding electronic payment transactions non-cash. Payment transactions using digital wallets are still relatively new, as a country with a majority Muslim population, it is undeniable that scholars have different opinions regarding the permissibility of electronic payment transactions, which is a difference of opinion among scholars, namely regarding contracts in electronic transactions, especially contracts from the user with the publisher, some scholars argue that the contract used is a contract wadi'ah while other scholars argue that the contract used is a contract qardh. The focus of the research refers to the formulation of the problem as follows: what are the opinions of scholars regarding electronic payments? and what are the factors that cause scholars to disagree regarding electronic payments from the perspective of the philosophy of Islamic law? The type of this research is qualitative research conducted by examining library materials and using normative and philosophical approaches. The results of the study show that scholars give different opinions regarding the issue of electronic payment transactions, some scholars agree, because electronic payments are an evolution of conventional payments, electronic payments are the same as making payments directly, their function is to make payments for goods and services only through digital media. However, some other scholars disagree because electronic payment transactions contain elements of usury. Differences of opinion among scholars regarding the issue of electronic payment transactions are very common considering that electronic payment transactions are a new type of transaction and are a case of muamalah contemporary about the problem, so that the scholars try to give opinions according to their respective scientific and mindsets.
