Abstract

Film is a work of art and culture which is a medium of visual and audiovisual communication made based on cinematographic rules. In the manufacturing process, films are made starting from story ideas to become real forms, it requires a long process and requires no small amount of capital. The intended capital is natural resources, human resources, technology, and funds. With the aim of producing quality works that can be appreciated by the community. Because of the high quality and appreciation, it is a gap for irresponsible people to take advantage of the popularity of the film in making personal gain by way of film piracy. Like the piracy that occurred in the film “Keluarga Cemara” which was uploaded and distributed on the illegal website Duniafilm21. it certainly brings great loss to the creator or copyright holder of the film itself. Based on this, the author is interested in examining how copyright protection is related to moral rights and economic rights for film creators according to Law no. 28 of 2014 Concerning Copyright. The Type of research is Normative (Legal Research) with a juridicalnormative approach. While the data analysis method used is deductive analysis. for the data collection method, the authors use the library research method with data collection tools using related documents. Copyright protection which includes moral rights and economic rights to the film Keluarga Cemara owned by PT. Visinema Pictures that is hijacked by uploading to illegal online sites has been guaranteed in Articles 8 and 9 of Law No. 28 of 2014 Concerning Copyright, any piracy committed can be subject to criminal sanctions as stipulated in Article 113 paragraph (2) and paragraph (4). The resolution of film piracy disputes can be carried out by litigation and nonlitigation.
