Abstract

Lion Parcel Yogyakarta is a company engaged in freight forwarding services. In the contract of delivery of goods, problems often occur in terms of implementation. In this case, to find out the implementation of the contract on the delivery service of goods using therules ijārah al-'amal, namely the rental of services or the contract of transferring use rights to an item with rental payments without being followed by the transfer of ownership of the goods or services. Leases or wages must have consent and acceptance in the form of words or statements indicating an agreement between the two parties in carrying out transactions. There are many legal rules related to goods delivery services, especially regarding consumer protection for users of goods delivery services against loss, damage, and delay of shipments. In fact, in using goods delivery services, there are often problems experienced by some consumers against the lack of responsibility given by the company to consumers regarding damage, loss, and delays in shipments. The purpose of this study is to find out how the implementation of the contract agreement uses the rules of fiqh muamalah ijārah al-'amal and how consumer protection efforts are given by Lion Parcel Yogyakarta to service users. To answer the main problems that occur in Lion Parcel Yogyakarta freight forwarding services, researchers use field research. Sources of data using primary data with the method of interview, observation and documentation with the company Lion Parcel Yogyakarta. The researcher uses a normative approach, namely examining legal issues based on consumer protection legislation, namely Law number 8 of 1999 concerning Consumer Protection. Then the data analysis was analyzed descriptively-qualitatively. Based on the results of this study, it can be seen how the implementation of the contract and responsibility of the Yogyakarta Lion Parcel company to consumers in shipping goods which are included in the Islamic legal rules of ijārah al-'amal. In making an agreement for service users to deliver goods, it is in accordance with Islamic law in carrying out the responsibility to deliver goods in accordance with the agreed contract agreement. Legally, consumer protection for damage, loss, and delay of goods resulting in loss to consumers has so far not been in accordance with the legislation. So far, Lion Parcel Yogyakarta has provided responsibility for the losses suffered by service users by compensating for 10x shipping costs.
