Abstract

The practice of buying and selling traditional packaged granulated sugar is a practice carried out by grocery store traders in the form of packing their own sugar into a plastic packaging traditionally. The practice of buying and selling traditional packaged sugar takes place in Mlg Village, Sleman, Yogyakarta. In this case, initially the seller bought 50 (fifty) kilograms of granulated sugar to be packaged and resold at retail using more economical packaging according to the needs of the community. In this case, the seller packs the sugar himself using simple equipment that doesn't seem to meet the applicable requirements. When viewed from the physical packaging of the granulated sugar, traditional packaged sugar also does not have a net weight label for the packaged sugar product. Based on the above background, the authors ask a question why the practice of buying and selling traditional packaged sugar is still carried out, then the practices carried out by sellers and buyers are analyzed using a sociological review of Islamic law. This research method uses field research using a qualitative research method. The process of collecting data was obtained by using interviews, observation and documentation by using a sociological approach that is descriptive of analysis which is useful for finding new facts in the field by directly examining and thoroughly analyzing it using the perspective of the sociology of Islamic law. This study shows the results that in the practice of buying and selling traditional packaged sugar, there are several factors that influence sellers and buyers. Factors from the seller include work, it can be done easily, sells faster, time is more flexible and has more benefits. While factors from buyers include a necessity, easy to obtain, more affordable prices, packaged according to needs and has a sweeter taste. In addition, another reason was found that the seller was weighing granulated sugar which contained an element of uncertainty (gharar). This practice can be seen as a lack of transparency on the part of the seller, so that this practice can be said to be a broken sale and purchase (fasid). Although traditional packaged granulated sugar contains an element of low uncertainty (gharar yasir), people do not abandon the product because it is considered more practical. Of course, with the consideration, effectiveness, willingness and humility of a buyer so that the buyer does not mind it. However, sellers need to pay attention to the aspect of certainty so that it is hoped that there will be a change in the practice of buying and selling traditional packaged sugar that is dualistic in society in the future
