Abstract

Bantuan Sosial Tunai Program (BST) is one of the government's alternative policies in overcoming problems that arise due to the corona virus disease 2019 (Covid-19) pandemic. The Pongangan Village Government in implementing the distribution of BST issued a deduction policy of IDR 50.000 for one family every month. So that the acceptance of BST by the community which should be IDR 300.000 for one family every month becomes only IDR 250.000 for one family every month at each stage of its distribution. This study seeks to answer the main questions: Why did the Pongangan Village Government provide a policy of cutting BST?; and How is the practice of cutting BST when viewed using Islamic law?. The method used in this research is a descriptive-analytic field research using a normative and sociological approach. Data collection techniques are carried out through observation, interviews, documentation and literature study. The results of this study concluded that the factors behind the policy of cutting BST by the Pongangan Village Government were data not updating, community disappointment, community welfare, layoffs, economic crisis, and declining community income. The practice of this BST cutting policy has both positive and negative impacts. The positive impacts is that social assistance will be more evenly distributed because it is to reach the wider community affected by Covid-19, help the economy of the affected community, especially during the pandemic, to avoid social jealousy, especially for people who have not received any social assistance from the goverment. There are also negative impacts in this withholding policy, namely the objections of BST recipients in submiting the discounted money because it already belongs to them and the protests of the BST recipient community regarding the data of prospective recipients so that they are immediately updated. In relation to the maslahah mursalah principle, the existence of this BST cutting policy has more benefits than harm.so that the rules of fiqh apply, goverment policies for the people must be based on maslahah. The benefit is in the form of people who initially did not receive social assistance to feel the benefits of this BST. Based on the principle, the policy of cutting BST is in accordance with the meaning of justice in Islamnic law, which contains equality, balance, giving rights to the owner and divine justice. In addition, the practice of withholding BST is in accordance with the principle of trust contained in Islamic law, namely conformity in the data on the receipt of BST withholding funds to the people who receive the withholding
