Abstract

Children in conflict with the law have the right to special legal protection. In dealing with children's cases, law enforcement officers must look at the position of the child so that it does not conflict with the rights of the child, the concept of child welfare, and the best interests of the child. The handling of children in conflict with the law is regulated in Law Number 11 of 2012 concerning the Juvenile Criminal Justice System. The existence of this law is expected to be able to guarantee the protection of children's rights in the whole process of examination in court. The problems that will be discussed in this study are efforts to protect children who are in conflict with the law at the Yogyakarta District Court and the trial process for children who are in conflict with the law at the Yogyakarta District Court. This type of research is field research, namely by observation through interviews with Juvenile Judge at the Yogyakarta District Court and interview with Community Counselors at Class I Yogyakarta Correctional Center (Bapas). The approach in this study uses an empirical juridical approach. This research is descriptive analytical, namely describing and analyzing the implementation of the Juvenile Criminal Justice System in an effort to protect children who are in conflict with the law at the Yogyakarta District Court. Methods of data collection using the method of observation, interviews, literature study, and documentation. The results of the study show that legal protection against children in conflict with the law at the Yogyakarta District Court are divided into legal protection for children in conflict with the law, child victims, and child witnesses. The legal protection provided is in accordance with the provisions contained in Law Number 11 of 2012 concerning the Juvenile Criminal Justice System. During the trial process, the Yogyakarta District Court provides legal protectionin the form of treating children humanely, providing special facilities and infrastructure, the examination is carried out in a trial that is closed to the public, is tried by a Juvenile Judge, and the Judge is obliged to seek diversion. As for the things that become obstacles to the Yogyakarta District Court include the trial process that has not fully implemented the provisions of the applicable laws and regulations, difficulties in seeking diversion, difficulty in applying a restorative justice approach, communication is still lacking, there are always conflicting parties, and mass media coverage
