Abstract

After the amendment to the Indonesian Constitution, the Constitutional Court (MK) became the institution authorized to examine the constitutionality of laws. The Constitutional Court's decision in practice has problems in its implementation. This is because some of the Constitutional Court's decisions are non-self-executing, so they require follow-up actions in the form of legislative actions, either changes or the formation of new laws. The follow-up as referred to in Article 10 paragraph (1) letter d of Law Number 15 of 2019 concerning Amendments to Law Number 12 of 2011 concerning the Establishment of Legislation, aims to avoid a legal vacuum due to the Constitutional Court's decision. The Constitutional Court's decision No.85/PUU-XI/2013 in Review of Constitutuionality of Law Number 7 of 2004 concerning Water Resources, completely annuls Law Number 7 of 2004 concerning Water Resources, to avoid a legal vacuum, Law Number 11 of 1974 is declared valid again. In 2019 Law Number 17 of 2019 concerning Water Resources was established to replace Law Number 11 of 1974. In legal considerations in Decision No. 85/PUU-XI/2013, the Constitutional Court provides guidelines for regulating water resources. this raises the question of how the position of legal considerations in the decision of the Constitutional Court no. 85/PUU-XI/2013 on the formation of Law no. 17 of 2019. Because after the Constitutional Court's decision, with the re-enactment of Law no. 11 of 1974 there was no legal vacuum. From these problems the questions arise: first, how is the binding power of the Constitutional Court's Considerations in the Judicial Review of the formation of laws? second, Is the formation of Law Number 17 of 2019 concerning Water Resources by the Constitutional Court Decision No. 85/PUU-XI/2013 Review of Law No. 7 of 2004 concerning Water Resources? To answer both of the questions, this research uses the theory of the rule of law and constitutionalism, judicial review of laws, and law formation as analytical tools. Legislation as the primary material, literature such as books, articles, and scientific works as secondary material. While dictionaries and encyclopedias as tertiary materials. The juridical-normative approach is used in this research. Thus this research is classified as library research. The results of this study indicate that the Constitutional Court Decision No. 85/PUU-XI/2013 contains a binding constitutional mandate to the DPR and the President as legislators to form laws governing water resources following the Constitutional Court Decision. The establishment of Law No. 17 of 2019 concerning Water Resources as a follow-up to the Constitutional Court's Decision No. 85/PUU-XI/2013 is following the Constitutional Court's Decision
