Abstract

Regional Governments in implementing Regional Autonomy have the authority to determine regulations in accordance with the conditions, aspirations and culture of their people, as stated in Article 18 Paragraph 6 of the 1945 Constitution of the Republic of Indonesia which states that "Regional Governments have the right to stipulate Regional Regulations and other regulations. to carry out autonomy and assistance tasks”. Based on this, the Pariaman City Government has the authority to make policies to regulate its area as it has set rules that prohibit LGBT acts in Pariaman City. The existence of this regulation is a form of response to public unrest due to the rise of LGBT acts in Pariaman City. In this study, the formulation of the problem is How to Implement Articles 24 and 25 of Regional Regulation No. 10 of 2018 which contains the prohibition of LGBT in Pariaman City based on Lawrence M Friedman's legal system theory? This type of research is field research, namely research by collecting data, describing and describing conditions in the field using an empirical juridical approach that will analyze the implementation of Articles 24 and 25 of Regional Regulation No. 10 of 2018 which contains the prohibition of LGBT acts in Pariaman City seen from the theory of the legal system of Lawrence M Friedman. Data collection was carried out by several methods, namely interviews, observations and documentation which would be used as primary data and secondary data in the form of literature books, data in the form of documents, laws and regulations, the Koran and the sunnah. The results of the research from the implementation of Articles 24 and 25 of Regional Regulation No. 10 of 2018 which contains a prohibition on LGBT acts in Pariaman City based on Lawrence M Friedman's legal system theory, which is not running effectively, because it does not meet the three elements of the legal system proposed by Lawrence M Friedman, both in terms of Legal Structure, Legal Substance (Legal Substance) and Legal Culture (Legal Culture).
