Abstract

Crime is a crime that often happens to whom, when, and wherever they are. In formal juridical, crime is a form of behavior that is contrary to human morals, is a society, violates the law and criminal law laws. The Special Region of Yogyakarta is a province that has the nickname of a student city, where of the many people in Yogyakarta, students are the most professions who are carrying out studies. Students who come from various different regions are scattered throughout Indonesia. So many of these crimes that occurred to the students themselves, one of which was the crime of theft of motorbikes which became the students' daily means of transportation. This study analyzes the criminal responsibility of the perpetrators of theft of motorcycles in the parking lot of the State Islamic University of Sunan Kalijaga, which is more specified in the responsibility of the perpetrators of theft of motorcycles at the State Islamic University of Sunan Kalijaga for the victims, in which case the responsibility or sanctions for the perpetrators of theft should take precedence. . Then from the focus of the discussion, it is dissected in the view of the Criminal Code Article 406 paragraph 1. This type of research is library research, with a normative approach. While the research sources obtained from primary data sources are information conveyed by officers, and secondary data are various books, national and international scientific works, which are related to state institutions. The law that applies at Sunan Kalijaga State Islamic University does not regulate when the perpetrator is not from the student side or other parts, but if the perpetrator is another person then the security from the University secures and interrogates the perpetrator and takes him to the nearest authorities for further action. In accordance with the rules in force in Indonesia, every perpetrator of the crime of theft can be punished for his actions. Article 362 of the Criminal Code concerning theft, perpetrators of motor thefts who carry out their actions must be dealt with in the fairest way possible, because in order to create a deterrent effect on the perpetrators.
