Abstract

The phenomenon of counterfeit clothing transactions, particularly at Toko X in Condongcatur, Sleman, Yogyakarta, reflects a growing disparity between legal norms and evolving social realities. Imitation or "KW" products are in high demand due to their affordable prices and visual similarity to original branded items. However, behind the popularity lies a range of legal and ethical issues, both in terms of positive law and Islamic law, including violations of intellectual property rights, dishonesty in trade, and injustice toward original producers. This research aims to analyze the practice of counterfeit clothing sales at Toko X through the lens of sociology of law and Islamic law, using preference theory and the legal awareness theory of Soerjono Soekanto. The research adopts a juridical-empirical approach with data collected through observation and interviews. Findings reveal that consumer motivations are primarily influenced by price considerations, social pressure, desire to follow trends, and a lack of legal awareness. Many consumers disregard the legality of such practices, believing them to be socially accepted and free of direct harm. From the perspective of Islamic law, such practices are classified as fāsid (invalid) transactions due to elements of deception and copyright infringement, which lead to fasād (social harm) in economic and moral contexts. The Indonesian Council of Ulama (MUI) Fatwa No. 1 of 2003 affirms that reproducing or using copyrighted works without permission is haram (forbidden). Thus, it is essential for the state and religious institutions to foster greater legal and ethical awareness among consumers and business actors, promoting fair, honest, and lawful commerce in accordance with both national law and Islamic principles.
