Abstract

Mortgage is the only guarantee institution for land rights, which is widely used in the banking world because of its safe and economic value is stable. Mortgage are born when the principle of publicity has been fulfilled by registering at Badan Pertanahan Nasional (BPN). Bank BRI Cabang Wonosari is a branch bank of BRI with a working area in Gunungkidul Regency which distributes loans in large amounts above 100 million rupiah. The large loans disbursed by Bank BRI Cabang Wonosari make it important that the guarantee of land rights is charged with Mortgage. The purpose of this study is to identify and explain (1) steps to overcome obstacles in fulfilling the publicity principle of Mortgage, and (2) conformity with the fulfillment of the publicity principle of Mortgage with Law on the Mortgage. The research was conducted by going directly to the field to find data and information, with the approach that the compilers used was a juridical-empirical approach, while the data collection methods were interviews and literature study. This research is categorized as field research and is a qualitative research. The results of this study are: First, the obstacles in fulfilling the publicity principle of Mortgage at Bank BRI Cabang Wonosari consist of obstacles related to document requirements that can be handled by customers themselves or with the help of the bank, obstacles to guarantee objects that can be overcome by applying to BPN, and problems in the registration system, namely the HT-el system which often has problems, thus requiring system repairs from BPN itself. Second, Bank BRI Cabang Wonosari has not fulfilled the publicity principle of Mortgage on all types of credit in accordance with the Law on the Mortgage.
