Abstract

Transportation is a reciprocal agreement between the carrier and the sender, where the carrier binds himself to organize the transportation of goods and/or people from one place to a certain destination safely, while the sender binds himself to pay transportation fees. PT Grab Indonesia is one of the providers of online transportation application services. In this case, Grab is present as an online transportation service, not only in transportation, but Grab is also present in various fields that make it easier for consumers. One of them is the Grabexpress service. Grabexpress provides a service where consumers can deliver goods anywhere. Currently, Grabexpress has collaborated with Tokopedia to provide goods delivery services via Grabexpress, so that the ordered goods can arrive faster. The problem that will be discussed in this thesis is whether legal protection for Grab drivers related to Grabexpress services in collaboration with Tokopedia has been realized. This type of research used in this study using the research field (FieldResearch), which conducted interviews with the driver Grab. The approach in this study is an empirical juridical approach, namely an approach that sees something in the legal reality in society. The research conducted in this legal research is descriptive-analytic, because it intends to clearly describe various things related to the object under study. The results show that the form of agreement between Grab drivers and PT Grab Indonesia is a partnership agreement made through a website or internet site. Legal protection for grab drivers has not been carried out optimally because it is not easy for the media to submit complaints or reports. The process for reporting is difficult and requires more costs because reporting via cellular phones requires pulses at a high cost. Therefore, the driver decided not to report but only wrote a note on the application which could only be written when the driver had finished sending the goods. When the goods are deemed unable to be transported, the driver chooses not to transport them at the risk of a decreased performance percentage which results in a reduced number of consumers or passengers who enter the driver's account.
