Abstract

This study discusses the application of sanctions for violators of health protocols at the Yogyakarta Giwangan Market. Yogyakarta Mayor Regulation No. 51 of 2020 concerning Guidelines for the Prevention and Control of Corona Virus Disease 19 (covid-19) During the New Normal Order in the City of Yogyakarta is one of the guidelines for law enforcers in the City of Yogyakarta in carrying out the task of controlling and imposing sanctions on violators of health protocols. With this perwali, the people of Yogyakarta City should be orderly and obedient to these regulations. In addition to Covid-19 which is dangerous for life safety, the sanctions for violators are also clearly stated in the Perwali. The background of this research is that there are still visitors and business actors (sellers) who have not been disciplined in carrying out health protocols in their activities at the Giwangan Market. Based on this background, the essence of this research is how effective the application of sanctions for violators of health protocols in Giwangan Market according to Perwali Yogyakarta No. 51 of 2020 and how to review the rules of maṣlahah on the application of these sanctions. The type of research used in this research is field research or field research, namely research carried out by going directly to the field or to a place that is the subject of research, namely the Yogyakarta Giwangan Market with an empirical juridical approach. While the data analysis method used is descriptive analytic. In the data collection method, the compiler uses the interview method, and documentation. Data analysis in this study uses qualitative analysis, which describes quality data in the form of regular, coherent, logical and non-overlapping sentences. After doing the research, Perwali Yogyakarta No. 51 of 2020 concerning Guidelines for the Prevention and Control of Corona Virus Disease 19 During the New Normal Order in the City of Yogyakarta has not been effective. In this regard, the implementation of law enforcement is influenced by five factors, namely the legal factor itself, law enforcement, facilities or facilities, society and culture. Where the five factors have their own problems. In addition, based on a review of the theory, the Yogyakarta Perwali maṣlaḥah is included in the ḍoruriyyah maṣlaḥah category judging by the urgency of the current pandemic condition. However, in its implementation at the Giwangan Market, the maṣlaḥah ideals have not been achieved. So based on the results of the analysis of the two theories, it can be concluded that the application of sanctions in the Giwangan Market has not been considered effective.
