Abstract

Elections are the realization of people's sovereignty. Elections are the spearhead of democracy, transforming people's voices into seats. With elections the people can choose who will be the leader or representative in parliamentary seats. People should as holders of democracy should be given the convenience of using their voting rights. However, it was slightly disturbed by not accommodating ballots for illiterate voters. Where the ballots of the DPR and DPRD only include the party number and logo and the name of the candidate without a photo of the candidate. From this issue the question arises: first, what are the problems faced by illiterate voters regarding the design of the DPR/DPRD ballot papers? Second, what are the efforts made by the KPU in accommodating illiterate voters? Third, is the solution provided by KPU able to accommodate the constitutional rights of illiterate people? To answer these problems, researchers will explore them using the theory of democracy, human rights (HAM) and the effectiveness of the law using empirical juridical research types and evaluative descriptive data analysis methods. The primary data that researchers used in this study were Republic of Indonesia KPU Decree Number 1944/PL.02-Kpt/01/KPU/XII/2018, DIY General Election Commission (KPU), Voting Committee (PPS), Voters Organizing Group (KPPS) and sampling of illiterate voters in DIY. While the data collection techniques that researchers use are observation, interviews and documentation. In this study, in fact the KPU had tried to design the ballot papers as well as possible so that they could accommodate all parties including voters with illiterates. The efforts made by KPU in accommodating illiterate voters were carried out in a number of ways which included adding the candidate number in the ballot, posting the candidate's photo on the bulletin board and socializing to voters regarding the procedures for the use of votes and the design of ballots used. Although there have been various ways taken by the KPU in dealing with illiterate voters, in reality the solution has not been able to accommodate the constitutional rights of illiterate people. This is proven by the large number of illiterate voters in the Special Province of Yogyakarta who are confused about the existing ballot design, which is 62.5% (sixty two point five percent).
