Abstract

Today, environmental protection and management is an obligation of every element of society. The level of education in Indonesia, which is still relatively low, make a lot of people who are still not aware about environment. Environmentalists are expected to be pioneers in growing public awareness and concern about the environment. Amendment to Law No. 32 of 2009 concerning the Implementation of Environmental Protection and Management through Law No. 11 of 2020 concerning Job Creation changes the provisions regarding the involvement of environmentalists in the process of preparing the Environmental Impact Assessment (EIA). The government through PP No. 22 of 2021 explains that environmentalists are still given access to remain involved in the process of making the EIA. From these problems the question arises: how is the involvement of environmentalists in the preparation of the Amdal (analysis of environmental impacts) before and after the amendment of Law no. 11 of 2022 Regarding Job Creation? The research method used by the authors is library research. The compilers in this research used primary data in the form of primary legal materials including several laws and regulations, secondary data in the form of books, journals, documents, online and non-online magazines, as well as tertiary data in the form of encyclopedias and dictionaries. The approach used by the compilers is a juridical-normative approach by analyzing and comparing legal rules regarding the involvement of environmentalists in the process of preparing the Amdal. In addition, the authors also use the principles of good governance as legal material in this study. The results of this study conclude that before the birth of Law no. 11 of 2020 concerning Job Creation, the involvement of environmental observers in the Amdal preparation process is part of the community by submitting suggestions, opinions, and responses (SPT) as well as objections to business plans or activities. After the birth of Law No. 11 of 2020 concerning Job Creation, the involvement of environmental observers is divided into two groups, namely those who are directly affected by the community and those who are not directly affected. The form of involvement of environmentalists after the amendment to Law No. 11 of 2020 concerning Job Creation is the submission of SPT relevant to the business or activity plan. UU No. 11 of 2020 brings a narrowing of the involvement of environmental observers so as to shift the orientation of environmental protection and management based on good governance, to efficiency and accelerated investment that requires natural exploitation.
