Abstract

Many parties in Indonesia do not impose restrictions on the period of general chairmans of political parties in their respective AD/ART one another. Even in Law No. 2 of 2011 amendments to Law No. 2 of 2008 concerning Political Parties are also not regulated regarding the limitation of the term of office of the general chairman of political parties. All internal powers, management mechanisms and party structures are regulated in the respective AD/ART in organizing political parties. Thus, some general chairpersons of political parties tend to personalize politics within the internal party which has led to the proliferation of political dynasties and nepotism. In this case, the author chooses the concept of Maslahah Mursalah to dissect more deeply the impact of restrictions on the general chairman of political parties in Indonesia. In addition, the type of this research is library research with library data collection techniques such as books, journals, documents and websites. Meanwhile, the method used in this research is a quantitative research that is descriptive in nature and includes analysis of several factors such as social, law and political. The results of this study indicate that the limitation of the term of office of the general chairman of a political party does not conflict with the concept of maslahah mursalah because there are several benefits that can be achieved from this problem, such as improving the institutionalization of political parties and the regeneration system and leader candidate. In fact, the absence of restrictions on general chairpersons of political parties can lead to political personalization, political dynasties and internal party factionalization. In Maslahah Mursalah's point of view, the limitation of the term of office does not conflict with the principles and values contained in Islamic law and aspects of democracy, even because the restriction system brings justice, benefit and benefit, so that is what is to be achieved. in the construction of Islamic law to reform the management of political parties to be more effective and return to their original nature as a forum for the community.
