Abstract

The development of the internet in Indonesia in 2021 has increased by 15.5% so that 73% of Indonesian people know the internet. One of the functions of the internet is to carry out buying and selling activities online. According to a report from Hootsuite and We Are Social, 87% of internet users in Indonesia have shopped online. One of the items that become the object of buying and selling is Photocard. Photocards are a form of merchandise in the form of photographs of idol group members printed on thick Art carton paper with a size of 55x85 mm and are not sold individually, but combined with other merchandise. Photocards can be found in C-Pop, J-Pop, I-Pop and the most popular are photocards of K-Pop idols. The popularity of K-Pop in Indonesia has increased over the past two decades, according to a report from Twitter revealing that Indonesia ranks first as the country with the highest number of tweets and unique writers regarding K-Pop and a survey from Jakpat explaining that buying merchandise is the most popular activity of K-pop fans at 38.21%. Buying and selling photocards online is mostly done through social media to the marketplace, one of which is Shopee. Buying and selling on Shopee has problems that consumers often experience. This problem occurs when the consumer has ordered a photo card. However, when the photo card that reaches the hands of the consumer is not appropriate and even has a defect The research method used is a field research method. The author conducts field research and examines legal provisions that are valid and knows what is happening in reality in the community and is described in an analytical descriptive manner based on the approach to laws and regulations, interview results, and results from questionnaires. The approach by reviewing statutory regulations aims as a basic basis for conducting research, while interviews and questionnaire data are used as accurate information that occurs in actual events in the community. The theory used in this research is agreement theory and legal protection theory. The data collection technique was carried out by reviewing the existing literature by collecting primary, secondary, and tertiary legal materials with corroborated by the results of interviews and questionnaires with consumers and sellers. The results of this study conclude that: First, the implementation of consumer protection at Shopee, refers to the provisions of the Shopee Terms of Service Article 21 which in essence the buyer gets a Shopee warranty period and its implementation is in the form of submitting a return of goods and/or funds provided that the submission can be done while it is still in the Shopee period. Shopee Guarantee. Second, if the consumer does not get the proper compensation, the consumer can file a problem with the Consumer Dispute Settlement Agency (BPSK) or the court.
