Abstract

The Special Region of Yogyakarta or better known as the "Student City" is a favorite place for the people of this country with a myriad of inherent characteristics as a tourist city, cultural city, culinary city, education city, and so on. Therefore, the local community helps meet the need for rental housing (boarding houses) for migrants while they are here. A variety of boarding houses available with various options and costs available. Then at the beginning of 2020 there was a Covid-19 (Coronavirus) epidemic which had a lot of impact or influence in various sectors. One of them is the boarding house business which is being loved especially Yogyakarta is one of the warehouses for college students. This research was conducted in 3 (three) boarding houses, namely Kos Anisa, Kos Grha Qonita, and Kos Bu Bejo. The methodology used in this study is empirical juridical (sociological) which is reviewed directly in everyday life along with applicable regulations (laws). Then the data used are primary (core) data obtained directly (interviews) by relevant sources and secondary (supporting) data, namely literature or literature which is based on the Civil Code (Civil Law). Data analysis uses qualitative methods in order to obtain accurate and appropriate results. So based on this, the main problems obtained were formulated, namely the implementation of rental payments, the impact felt due to the pandemic, as well as an analysis of the rental payments that occurred (due to the Covid-19 pandemic) based on the Civil Code at Kos Anisa, Kos Grha Qonita, and Kos Bu Bejo. From the research results obtained, the Covid-19 pandemic is an unexpected event which is included in the realm of Overmacht/Force Majeure in Article 1244-1245 of the Civil Code. So that in the 3 (three) boarding houses that have been studied, various impacts have been found in the form of changes in the payment system (receiving discounts/rebates on Grha Qonita’s boarding house and Bu Bejo’s boarding house) as well as changes in the rental contract where the rental period is experiencing a transition (from yearly to monthly in Anisa boarding house and Grha Qonita boarding house). Other impacts are in the form of income from the results of the boarding house rental business for the boarding house owners as well as getting relief/deductions in the payment of the boarding house rent for the boarding house tenants. In the case that occurred, it was included in the realm of relative/temporary Overmacht. Due to the implementation that occurred considering the Covid-19 pandemic could slowly decrease in this case, the implementation of the payment system and the boarding house rental agreement contract could return to normal/normal later.
