Abstract

One of the instruments to overcome the Covid-19 pandemic is the use of vaccines. Along with the increasing spread of Covid-19 in DKI Jakarta Province, the DKI Jakarta Provincial Government issued a new policy, namely mandatory vaccination which is a requirement for activities in public places as stated in Keputusan Gubernur DKI Jakarta Nomor 266 Tahun tentang PPKM Level 2 Corona Virus Disease 2019. However, many parties oppose the policy because it is considered as discrimination against Human Rights In this study, the author uses a type of library research, with the nature of descriptive-analytical research. The approach in this study uses a juridical-normative approach. Sources of data used in the form of primary data sources in the form of verses of the Qur'an and laws and regulations, secondary data sources in the form of books, journals, publications, and previous research as well as data related to this research. The theory used in this study is the theory of Al-Huquq Al-Insaniyyah fil Islamto analyze the obligation to carry out activities in the public sector in Keputusan Gubernur DKI Jakarta No 266 Tahun 2022 tentang PPKM Level 2 Corona Virus Disease 2019. The results show that the position of the vaccination policy which is a requirement for activities in public places in DKI Jakarta Governor Regulation Number 266 of 2022 concerning PPKM Level 2 Corona Virus Disease 2019 is a type of State Administrative Decision (KTUN) Which contains legal acts of State Administration Entities or Officials (Governor) whose meaning has been expanded after the issuance of the Government Administration Law, and the contents of this Decree do not conflict with the definition of the right to reside in Al-Huquq Al-Insaniyyah fil Islam as a concept of right human rights. Humans in Islam essentially provide maximum protection so that human safety is maintained. and fully protected and the realization of public interest and individual interest based on a balance between rights and obligations.
