Abstract
The Non-Fungible Token transaction, which is a modern transaction, also has no benefit from the transaction because of the possibility of overspeculation which has a detrimental impact on one of the parties conducting the transaction, so that the benefits to be achieved are still unclear. The formulation of the problem in this study is how the non-fungible token transaction system is a digital asset, and how is the perspective of Islamic law on non-fungible token transactions and their legal determination. Research on analysis of non-fungible token transactions from the perspective of Islamic economic law. remember This research is a type of library research. The nature of the research is qualitative. The approach used in this study is a normative type. The data collection technique in this study uses the document review method, with data sources in the form of books, journals, articles and research documents that are relevant to the basics of Islamic economic law. . From this study, it can be concluded that Non-Fungible Token transactions according to buying and selling in Islam are valid if they do not violate the provisions agreed upon by the scholars, both transactions, transaction objects, contracts, and also the means of payment used. Based on Islamic economic law. Non-fungible token transactions are included in the ghoiru musamma contract (mustahdatsah contract) or contracts whose legal stipulations are not explicitly explained in the Qur'an and Hadith but are discussed by the fuqaha. NFT transactions are prohibited, as long as there are transactions with the pillars and conditions of buying and selling contracts in Islam. This is found in the Islamic provisions that regulate the monetization of non-fungible token sale and purchase transactions. As long as the transaction does not conflict with Islamic law, it is essentially permissible.
